IT Forensics for Lawyers & Criminal Defence Solicitors – independent examination of digital evidence

As IT forensic experts, we support solicitors and criminal defence lawyers at every stage of criminal proceedings – from the initial assessment during the pre-trial investigation, through the trial, to appeals, cassation appeals or retrials.

Our investigation is conducted without prejudice and independently of the assessment made by the investigating authorities. We attach particular importance to the critical examination of existing expert reports and investigation files, as well as to transparent documentation. Where necessary, we draw up an independent technical counter-report.

ASSESSMENT OF THE EVIDENCE

How we examine the technical evidence for the defence

We examine investigation files, official reports and available expert reports for technical completeness, plausibility and alternative explanations. Where there are doubts regarding the methodology or conclusions of an expert report, we prepare an independent technical counter-report. This review is carried out independently of the assessment made by the investigating authorities and is based solely on the technical evidence.

OUR APPROACH

This is how your examination will be carried out

A transparent process – from the initial enquiry to the handover of the report.

1
We examine the investigation files, the seized data storage media and the expert reports available, and determine which technical issues are relevant to the defence.
2
Expert reports and official reports are examined for methodology, completeness and alternative explanations; where necessary, we prepare an independent technical counter-report.
3
Associations between individuals, accounts and devices, as well as digital traces from files, communications and media, are independently traced using technical means.
4
If new evidence or a change in circumstances comes to light during the trial, we will examine it promptly and present the findings in a way that is clear to the defence.
5
Even after the trial has concluded, we provide support with appeals, applications for review or applications for a retrial should new technical evidence come to light.

Why is an independent technical audit important for the defence sector?

Investigating authorities assess digital evidence from their own perspective. An independent technical examination can highlight alternative explanations, gaps in the investigation file or methodological weaknesses in an existing expert report.

At which stages of the proceedings does LanCologne provide support?

We provide support at every stage of criminal proceedings – from the initial assessment during the pre-trial investigation, through the trial, to appeals, cassation appeals or retrials.

What is a technical counter-report?

A technical counter-report independently examines the methodology and conclusions of an existing expert report and determines whether the findings are technically sound.

How quickly can new evidence be examined during the trial?

If new digital evidence or a change in the facts of the case comes to light during the trial, we will examine it promptly and present the findings in a way that is clear to the defence.
