A private expert report is a technical investigation carried out by an expert on behalf of a party, outside the context of a direct court appointment. It addresses a clearly defined question and documents the investigations carried out to answer it. Unlike a simple data recovery operation or a report generated by a forensic programme, it includes a professional assessment of the findings, their significance and their limitations.

The report may subsequently be submitted to a solicitor, an insurance company, a business or a court. The relevant authority will decide whether, and to what extent, it is taken into account in legal proceedings.

To begin with, we work with the client or their solicitor to clarify exactly which specific question needs to be answered. As part of this process, we also assess whether the available equipment and documentation are, in principle, suitable for reaching the desired conclusion. This enables us to limit unnecessary investigations and avoidable costs at an early stage.

Once the device has been accepted and documented, a data backup suitable for forensic purposes is carried out, where technically feasible. The analysis focuses on the data areas relevant to the assignment. Automatically generated tool results are not accepted without verification, but are validated against the original artefacts, databases, metadata and other evidence.

Upon request, suitable extracts from previously prepared expert reports may be provided as references, following full anonymisation and redaction. In doing so, all personal data, reference numbers, device identifiers, communication content and procedural details that could allow conclusions to be drawn about those involved or specific proceedings will be removed.

LIMITATIONS & CONCLUSION

What you should know

Not all the required information is still available or technically accessible. In particular, encryption, missing login details, faulty devices, overwritten file systems and cloud synchronisation can limit the scope of the investigation. A preliminary technical assessment should therefore be carried out before any extensive work begins. The scope of the investigation can then be determined in stages; for example, first backing up and reviewing the data, followed by a targeted detailed analysis, and finally a written report.

A private smartphone forensic report provides an independent, methodologically transparent assessment of digital traces. It clarifies which claims can be technically substantiated, which are merely possible, and which cannot be substantiated on the basis of the available data.
